Arresting officers must perform their duties

ARRESTING officers for criminal cases must explain to court the reasons for not having police files ready during court appearance for prisoners.
Lae district court magistrate Edward Kupo said this when the police investigation files for a murder case were not ready to be presented in court for hearing yesterday.
Mr Kupo said murder is among the top offences and an offender must go through trial and face the consequences of his or her action and not for the court to strike out the case due to delays in file submission.
He said arresting officers have to prepare investigation files and ensure it is ready within three months.
Mr Kup when presiding over the case of Rex Kaware, 40 from Wagai village, Ialibu district of Southern Highlands province said it took almost four months to have the files for that case come before the court.
“Justice delayed is justice denied so as officers in power in facilitating judiciary processes, we must not abuse the powers vested to us, instead perform our duties and assist prisoners who are jailed to fast track their cases,” Mr Kupo said.
Mr Kupo said arresting officers must have timeframes to complete their investigation reports and have the files ready because adjourning of cases is a waste of time and files not ready is not a good reason.
He said yesterday is the final adjournment of the murder case and the arresting officers must ensure the files are ready for prosecution when the case returns to court on April 8.
Kaware and two other people are in court for an assault at Banana block along Cassowary Road over a piece of land.
The three hit the victim with an iron rod on his legs and side of his body on October 27, 2018 and the victim died five days later.
