Trio cleared of wilful murder

THREE men have now been cleared of wilful murder charges in the committal court after the prosecution failed to establish enough evidence to prove their involvement in the death of a man at Gerehu Stage Two last year.
Jacob Wapiri, Alex Koi and Simon Lulu were discharged and released from Correctional Service custody yesterday after police investigators failed to complete an investigation within the three months that the trio had been in remand at the Bomana prison.
Presiding magistrate Cosmas Bidar, underlined during the hearing yesterday that an arrest had to be substantiated by evidence in order for the accused to remain in custody, but that was not the case in this instance.
“Arresting someone for a crime is one thing, but proving the charges with evidence is something else,” said Mr Bidar.
The trio had been arrested and charged after they were suspected of murdering Michael Kerenga at Gerehu Stage Two last year.
Mr Bidar said that the discharge of the three suspects does not stop police from further investigating the matter, at which point, further arrests could be made.
