“Pay up or I will take the matter to court.”

Bena Construction managing director Nick Allan (pictured with copies of the government and independent audit reports and certificate of completion) made that stinging remark as he has no choice now but to take on his lawyers advice to take the matter to court.

This is in regards to a million kina major refurbishment job that Bena Construction did on Awaba Secondary School in Balimo, Western Province over seven years ago.

Bena Construction won the public tender via the Department of Mineral Policy and Geohazards Management, of which the funds are derived from Ok Tedi’s non Community Mine Continuation Agreement (CMCA) investment trust funds.

The funds are specifically for social and economic infrastructure projects.
Bena Construction only received part payment and to this day have been kept in the dark over the rest which includes variations.
Mr Allan says the 31 buildings which included classrooms, library, staff houses, dormitories and a workshop to name a few was a major project for his Port Moresby-based company.

“We even had to dig deep to help complete the job on time…because the students and staff needed to use the facilities.”
He said despite not officially handing over the facilities, the school is currently using them.
Mr Allan said after so many years of being patient he says he now has a copy of the government and independent audit report that clearly advises the government to pay his company.

“If that is the case then why are they not paying my company?
“I just want to be sorted out so that I can recover my losses and close this frustrating chapter in my life.
“It has affected my family life and role I play in my community at Tatana where I am in the process of completing a church.
“I just want what is due and with interest growing it is in their best interests that Bena Construction be sorted out or else I will have take my lawyers advice to take the matter further.”
